Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Sự ủng hộ và hỗ trợ của cộng đồng dân cư đối với các chính sách bảo tồn hệ sinh thái biển và ven biển là quan trọng và cần thiết. Tuy nhiên, các nghiên cứu đa quốc gia hiện nay về các yếu tố tác động đến vấn đề này vẫn còn nhiều thiếu sót. Hơn nữa, các nghiên cứu liên quan đến biến đổi khí hậu có khả năng làm suy giảm sự ủng hộ hành vi bảo tồn (...) biển và ven biển vẫn còn nhiều hạn chế. Cho nên, nghiên cứu này được thực hiện nhằm tìm hiểu các tác động của nhận thức liên quan đến biến đổi khí hậu của các bên liên quan đối với sự sẵn sàng hỗ trợ bảo vệ biển. Nghiên cứu áp dụng phương pháp Bayesian Mindsponge Framework (BMF) cho tập dữ liệu gồm 709 cá nhân liên quan tới hệ sinh thái biển và ven biển ở 42 quốc gia, thuộc dự án MaCoBioS, được tài trợ bởi Ủy ban Châu Âu. Kết quả phân tích chỉ ra rằng cá nhân có suy nghĩ rằng xã hội đang làm nhiều việc để giải quyết tác động của biến đổi khí hậu, phát triển công nghệ có thể giúp giải quyết các vấn đề môi trường, và việc ứng phó với biến đổi khí hậu sẽ gây thiệt hại cho kinh tế đất nước sẽ có xu hướng không sẵn sàng hỗ trợ bảo vệ biển hơn. Dựa trên kết quả này, chúng tôi gợi ý rằng việc nâng cao nhận thức và kiến thức của các cộng đồng dân cư gắn liền với biển có thể giúp tăng cường hành động và cải thiện sự đồng hành, hỗ trợ của chính họ đối với các chương trình bảo tồn đại dương và ven biển. Xa hơn nữa, những nhận thức này sẽ là nền tảng cho việc xây dựng văn hóa thặng dư sinh thái. (shrink)

Các nhà khoa học trong lĩnh vực nhân học, địa lý và các lĩnh vực khác trong khoa học xã hội và nhân văn từ lâu đã cho rằng môi trường sống của con người ảnh hưởng sâu sắc đến hệ thống giá trị và thực tiễn văn hóa của họ. Shota Shibasaki, Ryosuke Nakadai và Yo Nakawake đã phát triển dựa trên ý tưởng này, chứng minh rằng các đặc điểm sinh thái địa phương định hình sự xuất hiện (...) của các loài động vật ranh mãnh trong truyền thuyết dân gian. Dựa trên phát hiện của họ và khung quản trị tri thức SM3D (Serendipity-Mindsponge-3D), chúng tôi thảo luận về việc khả năng sáng tạo các sản phẩm văn hóa của cá nhân hoặc nhóm phụ thuộc vào tính sẵn có và khả năng tiếp cận thông tin từ môi trường xung quanh. Do mất đa dạng sinh học và biến đổi khí hậu, những nguồn tài nguyên quý giá cho sáng tạo văn hóa đã bị suy giảm. Do đó, việc bảo tồn đa dạng sinh học và hành động vì khí hậu cần được xem như những giá trị nền tảng của một nền văn hóa tiến bộ và nhân văn. Chỉ khi đó, chúng ta mới có thể tiếp tục duy trì và nâng cao năng lực sáng tạo văn hóa của xã hội. (shrink)

Khi góc nhìn chủ quan được mở rộng, con người có thể tưởng tượng ra nhiều khả năng có thể xảy ra hơn, từ đó tăng cường sự sáng tạo của họ .

Nghiên cứu này xác định tác động của sự sẵn sàng đến quyết định áp dụng công nghiệp 4.0 tại các doanh nghiệp nhỏ và vừa (DNNVV) trên địa bàn TP. Hồ Chí Minh, vai trò điều tiết của đặc điểm lãnh đạo. Bằng phương pháp ước lượng bình phương nhỏ nhất từng phần (PLS-SEM) dựa trên mô hình nghiên cứu tích hợp lý thuyết khuyếch tán đổi mới (DOI) và khung lý thuyết công nghệ - tổ chức - môi (...) trường (TOE), nghiên cứu đã tiến hành khảo sát 353 DNNVV. Kết quả nghiên cứu cho thấy, khi cả 3 yếu tố: Công nghệ, Tổ chức, Mô trường đã sẵn sàng, thì doanh nghiệp sẽ quyết định áp dụng sản phẩm của công nghiệp 4.0. Đặc điểm lãnh đạo có vai trò điều tiết tích cực trong mối quan hệ tác động của Sự sẵn sàng đến Quyết định áp dụng. Kết quả này là cơ sở để giúp các nhà hoạch định chính sách, quản trị doanh nghiệp đưa ra những giải pháp để triển khai ứng dụng các thành tựu khoa học - công nghệ của công nghiệp 4.0, nhằm nâng cao hiệu quả trong hoạt động sản xuất, kinh doanh. Trước những khó khăn và thách thức của các nhà khoa học trẻ và các nhà khoa học ở những nước đang phát triển do thiếu tài nguyên và cơ hội được tiếp cận với các kiến thức và phương pháp nghiên cứu bài bản…, các nhà khoa học Việt Nam đã phát triển nền tảng Cổng thông tin SM3D hỗ trợ đào tạo phương pháp nghiên cứu khoa học xã hội cho các nhà khoa học. Sau gần 2 năm (...) được triển khai, Cổng thông tin SM3D được đánh giá là một trong những sáng kiến đóng góp tiêu biểu của khoa học Việt Nam cho cộng đồng khoa học quốc tế, đặc biệt là đối với các nước đang phát triển. Hypothalamic and ovarian GnRH mRNA and pituitary LH~ mRNA levels were determined by respective RNA-blot hybridizations, and ovarian GnRH and estradiol contents and serum LH levels were measured by respective radioimmunoassays. Three animal models such as 1) PMSG-treated, 2) PMSG and heG-treated immature rats and 3) proestrous stage of adult rats were used. Immature rats (25-days old) were administered with PMSG (10 iu) at 10:00 hand 48 h later with heG (10 iu) to induce ovulation. In the PMSG-injected model, hypothalamic GnRH mRNA levels were markedly augmented about 9-fold at 50 h, and pituitary LH mRNA 3-fold at 52 h after PMSG administration. Serum LH levels were increased to the preovulatory surge levels at 56 h, and ovarian GnRH mRNA levels were augmented 4-fold at 60 h after PMSG injection. Administration of heG also induced a marked enhancement in ovarian GnRH mRNA levels in comparison to the values shown in both intact and PMSGtreated rats at 52 hand 54 h, respectively. In the proestrous stage of normal adult rats, pituitary LH~ mRNA levels were peaked at 16:00 h. The preovulatory LH surge was evident at 4 h before increment in ovarian GnRH mRNA levels as shown in PMSG-treated rats. The present study clearly showed the sequential increase in hypothalamic GnRH mRNA, pituitary LH~ mRNA and ovarian GnRH mRNA levels, indicating that ovarian GnRH may play a possible role in the control of follicular maturation and the ovulation process. This avoids problems, created in the accounts of Fiering, Lee, and especially Crisp, about the inherently idealist character of Edwards' occasionalism.

Trong những năm gần đây, khái niệm phát triển bền vững đã trở nên phổ biến trong các ngành công nghiệp trên khắp thế giới. Người tiêu dùng ngày càng tỏ ra quan tâm đến tác động môi trường tạo ra từ các lựa chọn của họ, điều này đã thúc đẩy các công ty phải sử dụng các thông điệp và biện pháp thân thiện với môi trường. This book examines the legal and moral theory behind the law of evidence and proof, arguing that only by exploring the nature of responsibility in fact-finding can the role and purpose of much of the law be fully understood. Ho argues that the court must not only find the truth to do justice, it must do justice in finding the truth.

This article synthesizes the current theoretical attempts to understand human-machine interactions and introduces seven premises to understand our emerging dynamics with increasingly competent, pervasive, and instantly accessible algorithms. The hope that these seven premises can build toward a social theory of human-AI cocreation. The focus on human-AI cocreation is intended to emphasize two factors. First, is the fact that our machine learning systems are socialized. Second, is the coevolving nature of human mind and AI systems as smart devices form an (...) indispensable part of our cognitive scaffolds, thus, shaping how we perceive the world and ourselves. The seven premises include: primacy of social structures; human’s desire for freedom and autonomy; AI systems will form inseparable parts of our cognitive/affective scaffolds and can change our self-understanding; philosophy and humanistic foundations on human flourishing as a guide to human-AI interaction; mindsponge information-filtering process; acculturative process of how values change and emerge from human-AI interaction; overlapping Venn diagram of the human-human, human-nature, and human-machine interactions. This article concludes with a discussion on human agency in our entanglements with socialized machines and the illusoriness of the Cartesian agent view of the mind. (shrink)

This paper argues that phenomenal consciousness is what makes an entity a welfare subject. I develop a variety of motivations for this view, and then defend it from objections concerning death, non-conscious entities that have interests (such as plants), and conscious entities that necessarily have welfare level zero. I also explain how my theory of welfare subjects relates to experientialist and anti-experientialist theories of welfare goods.

In recent decades, the intertwining ideas of self-determination and well-being have received tremendous support in bioethics. Discussions regarding self-determination, or autonomy, often focus on two dimensions—the capacity of the patient and the freedom from external coercion. The practice of obtaining informed consent, for example, has become a standard procedure in therapeutic and research medicine. On the surface, it appears that patients now have more opportunities to exercise their self-determination than ever. Nonetheless, discussions of patient autonomy in the bioethics literature, which (...) focus on individual patients making particular decisions, neglect the social structure within which health-care decisions are made. Looking through the lens of disability and informed by the feminist conception of relational autonomy, this essay argues that the issue of autonomy is much more complex than the individualist model suggests. The social system and the ableist ideology impose various forms of pressure or oppressive power that can affect people’s ability to choose according to their value system. Even if such powers are not directly coercive, they influence potential parents’ decisions indirectly—they structure their alternatives in such a way that certain options are never considered as viable and other decisions must be made. This paper argues that, instead of only focusing on the individual act of decision-making, we need to pay attention to the social structure that frames people’s decision. (shrink)

This paper endeavors to understand the research landscape of finance research in Vietnam during the period 2008 to 2020 and predict the key defining future research directions. Using the comprehensive database of Vietnam’s international publications in social sciences and humanities, we extract a dataset of 314 papers on finance topics in Vietnam from 2008 to 2020. Then, we apply a systematic approach to analyze four important themes: Structural issues, Banking system, Firm issues, and Financial psychology and behavior. Overall, there have (...) been three noticeable trends within finance research in Vietnam: (1) assessment of financial policies or financial regulation, (2) deciphering the correlates of firms’ financial performances, and (3) opportunities and challenges in adopting innovations and ideas from foreign financial market systems. Our analysis identifies several fertile areas for future research, including financial market analysis in the post-COVID-19 eras, fintech, and green finance. (shrink)

Satirical cartooning in Vietnam is subject to a complex dynamic: an increasingly liberalised and internationalised economy, and the rise of social media in a one-party state. This article examines what state-sanctioned satirical cartoons can reveal about the representation and management of political criticism in such a context. We find a growing trend of depicting corruption as a systemic problem, which is present in 45 per cent of the sample and in 70 per cent of the 20 most-viral cartoons in one (...) of Vietnam’s most popular magazines, Tuoi Tre Cuoi (Youth Humour). This trend can be interpreted as a change in the sensibility of audiences and a shift toward a more tolerant media landscape. The trend, however, may also be a worrying sign of the dual dangers of cynicism in Vietnamese politics: the development of apathy among audiences and the cynical use of art by authorities. Despite these concerns, we argue, political cartoons in Vietnam provide an important public avenue for collective political reflection and everyday social solidarity. (shrink)

A famous mathematical theorem says that the sum of an infinite series of numbers can depend on the order in which those numbers occur. Suppose we interpret the numbers in such a series as representing instances of some physical quantity, such as the weights of a collection of items. The mathematics seems to lead to the result that the weight of a collection of items can depend on the order in which those items are weighed. But that is very hard (...) to believe. A puzzle then arises: How do we interpret the metaphysical significance of this mathematical theorem? I first argue that prior solutions to the puzzle lead to implausible consequences. Then I develop my own solution, where the basic idea is that the weight of a collection of items is equal to the limit of the weights of its finite subcollections contained within ever-expanding regions of space. I show how my solution is intuitively plausible and philosophically motivated, how it reveals an underexplored line of metaphysical inquiry about quantities and locations, and how it elucidates some classic puzzles concerning supertasks. The emphasis on evidence based medicine (EBM) has placed increased focus on finding timely answers to clinical questions in presence of patients. Using a combination of natural language processing for the generation of clinical excerpts and information theoretic distance based clustering, we evaluated multiple approaches for the efficient presentation of context-sensitive EBM excerpts.

A number of traditional philosophers and religious thinkers advocated an ineffability thesis to the effect that the ultimate reality cannot be expressed as it truly is by human concepts and words. However, if X is ineffable, the question arises as to how words can be used to gesture toward it. We can't even say that X is unsayable, because in doing so, we would have made it sayable. In this article, I examine the solution offered by the fifth-century Indian grammarian-philosopher (...) Bhartrhari and develop it into a linguistic strategy based on the imposition-cum-negation method. The purpose is to show how we can non-contradictorily say, or rather indicate, the unsayable. I develop and defend a sense-datum theory of perception. My theory follows the spirit of classic sense-datum theories: I argue that what it is to have a perceptual experience is to be acquainted with some sense-data, where sense-data are private particulars that have all the properties they appear to have, that are common to both perception and hallucination, that constitute the phenomenal characters of perceptual experiences, and that may be aptly described as pictures in-side one’s head. But my theory also (...) diverges from conventional sense-datum theories in some key respects: on my view, (1) sense-data are first-person presentations of neural states, (2) the sensational qualities of sense-data differ in kind from the sensible qualities of external objects, and (3) sense-data are the vehicles in virtue of which we perceive, rather than the objects that we perceive. I argue that this package of claims is appropriately labeled ‘sense-datum theory’, and that the resultant view ought to be a live contender in contemporary philosophy of perception. (shrink)

In recent years, the science and the philosophy of consciousness has seen growing interest in structural questions about consciousness. This is the Editorial Introduction for a special volume for Philosophy and the Mind Sciences on “Structuralism in Consciousness Studies.”.

A number of analytical philosophers have recently endorsed the view that the world itself is indeterminate in some respect. Intriguingly, ideas similar to the view are expressed by thinkers from Chinese Madhyamaka Buddhism, which may shed light on the current discussion of worldly indeterminacy. Using as a basis Chinese Madhyamaka thought, together with Jessica Wilson’s account of indeterminacy, I develop an ontological conception of indeterminacy, termed ontic indeterminacy, which centres on two complementary ideas—conclusive indeterminability and provisional determinability. I show that (...) OI is well-equipped to tackle several issues of worldly indeterminacy. When are logical theories equivalent? I discuss the notion of ground-equivalence between logical theories, which can be useful for various theoretical reasons, e.g., we expect ground-equivalent theories to have the same ontological bearing. I consider whether intertranslatability is an adequate criterion for ground-equivalence. Jason Turner recently offered an argument that first-order logic and predicate functor logic are ground-equivalent in virtue of their intertranslatability. I examine his argument and show that this can be generalized to other intertranslatable logical theories, which supports (...) the following: intertranslatability implies ground-equivalence. I also argue, however, that this ground-equivalence argument can be challenged as it faces a dilemma. The dilemma arises because the argument allows two distinct readings, the ‘internal’ and the ‘external’ reading. I argue that the argument turns out to be unsuccessful in both readings. The upshot of this dilemma in both philosophy of logic and metaphysics is considered. (shrink)

Mahayana Buddhist philosophers’ attitude toward language is notoriously negative. The transcendental reality is often said to be ineffable. One’s obsession to apprehend the truth through words is an intellectual disease to be cured Attachment to verbal and conceptual proliferation enslaves oneself in the afflictive circle of life and death. Nevertheless, no Buddhist can afford to overlook the significance of language in preaching Buddhist dharmas as well as in day-to-day transactions. The point is not that of keeping silence. Rather, one should (...) understand and use language in such a way that one alludes to the unsayable reality and somehow escapes the bewitchment of language. Perhaps with this realization in mind, Mahayana Buddhist metaphysicians had fostered the penchant for using, at the sentential level, denials, negations and paradoxes to couch their views. In a similar vein but mainly at the word level, Dignaga (ca. 480-540 CE) the Yogacara epistemologist’ offered us a theory of language known as apoha doctrine in his landmark work Pramiinasamuccaya (henceforth PS). Selim Berker argues that epistemic consequentialism is pervasive in epistemology and that epistemic consequentialism is structurally flawed. is incorrect, however. I distinguish between epistemic consequentialism and epistemic instrumentalism and argue that most putative consequentialists should be considered instrumentalists. I also identify the structural problem of epistemic consequentialism Berker attempts to pinpoint and show that epistemic instrumentalism does not have the consequentialist problem.

Is a human more conscious than an octopus? In the science of consciousness, it’s oftentimes assumed that some creatures (or mental states) are more conscious than others. But in recent years, a number of philosophers have argued that the notion of degrees of consciousness is conceptually confused. This paper (1) argues that the most prominent objections to degrees of consciousness are unsustainable, (2) examines the semantics of ‘more conscious than’ expressions, (3) develops an analysis of what it is for a (...) degreed property to count as degrees of consciousness, and (4) applies the analysis to various theories of consciousness. I argue that whether consciousness comes in degrees ultimately depends on which theory of consciousness turns out to be correct. But I also argue that most theories of consciousness entail that consciousness comes in degrees. (shrink)

Theorists who advocate worldly (metaphysical or ontological) indeterminacy—the idea that the world itself is indeterminate in one or more respects—should address how we understand the signifying nature and function of language in light of worldly indeterminacy. I first attend to Sengzhao and Jizang, two leading thinkers in Chinese Sanlun Buddhism, to reconstruct a Chinese Madhyamaka notion of ontic indeterminacy. Then, I draw on the thinkers’ views to propose a provisional (non-definitive) understanding of the nature and use of language. Under this (...) understanding, an expression signifying a thing is provisional in that the expression connotes no determinate feature of the thing. (shrink)

Một phần quan trọng của thách thức này là sự xung đột giữa một bên là những yếu tố có tính lịch sử và văn hóa, và bên kia là sự phát triển của công nghệ thông tin và xu hướng hợp tác quốc tế mở rộng. Nghiên cứu trường hợp của Nhật Bản có thể mang lại những bài học quan trọng trong việc xây dựng khả năng đào tạo và quản lí đạo đức nghiên cứu tại một nền khoa học mới hội nhập như Việt Nam. This paper develops a theory of analog representation. We first argue that the mark of the analog is to be found in the nature of a representational system’s interpretation function, rather than in its vehicles or contents alone. We then develop the rulebound structure theory of analog representation, according to which analog systems are those that use interpretive rules to map syntactic structural features onto semantic structural features. The theory involves three degree-theoretic measures that capture three independent ways in which (...) a system can be more or less analog. We explain how our theory improves upon prior accounts of analog representation, provides plausible diagnoses for novel challenge cases, extends to hybrid systems that are partially analog and partially symbolic, and accounts for some of the advantages and disadvantages of representing analogically versus symbolically. Virtue epistemology maintains that epistemic normativity is a kind of performance normativity, according to which evaluating a belief is like evaluating a sport or musical performance. I examine this thesis through the objection that a belief cannot be evaluated as a performance because it is not a performance but a state. I argue that virtue epistemology can be defended on the grounds that we often evaluate a performance through evaluating the result of the performance. The upshot of my account is (...) that when a belief is evaluated under performance normativity, what we evaluate is not belief, but cognitive performance. My account of virtue epistemology offers a simple explanation of why knowledge is more valuable than true belief. (shrink)

This paper examines the idea of "objective phenomenology," or a way of understanding the phenomenal character of conscious experiences that doesn’t require one to have had the kinds of experiences under consideration. My central thesis is that structural facts about experience—facts that characterize purely how conscious experiences are structured—are objective phenomenal facts. I begin by precisifying the idea of objective phenomenology and diagnosing what makes any given phenomenal fact subjective. Then I defend the view that structural facts about experience are (...) objective. I also argue that structural facts about experience, despite being objective, nevertheless still give rise to an explanatory gap. (shrink)

In his essay “Things Do Not Move,” Sengzhao (374?−414 CE), a prominent Chinese Buddhist philosopher, argues for the thesis that the myriad things do not move in time. This view is counter-intuitive and seems to run counter to the Mahayana Buddhist doctrine of emptiness. In this book chapter, I assess Sengzhao’s arguments for his thesis, elucidate his stance on the change/nonchange of things, and discuss related problems. I argue that although Sengzhao is keen on showing the plausibility of the thesis, (...) he actually views the myriad things as both changing and unchanging and upholds the nonduality of motion and rest. In fact, the nonmoving thesis follows from the discernment that things change from moment to moment without there being any enduring stuff in the process. Among philosophical works that confer a higher ontological status on nonchange over change, Sengzhao’s essay is unique and well worth pondering. (shrink)

It is widely maintained that doxastic norms that govern how people should believe can be explained by the truism that belief is governed by the correctness norm: believing p is correct if and only if p. This approach fails because it confuses two kinds of correctness norm: (1) It is correct for S to believe p if and only p; and (2) believing p is correct qua belief if and only if p. Only can (2) be said to be a (...) truism about belief, but it cannot ground doxastic norms. (shrink)

Some philosophers think that life is worth living not merely because of the goods and the bads within it, but also because life itself is good. I explain how this idea can be formalized by associating each version of such of a view with a function from length of life to the value generated by life itself. Then I argue that every version of the view that life itself is good faces some version of the following dilemma: either (1) good (...) human lives are worse than very long lives wholly devoid of pleasure, desire-satisfaction, knowledge, or any other goods, or (2) very short lives containing nothing but suffering are worth living. Since neither result is plausible, we ought to reject the view that life itself is good. On the view I favor, any given life may be worth living because of the goods that it contains, but life itself is neutral. (shrink)

Conscious experiences are characterized by mental qualities, such as those involved in seeing red, feeling pain, or smelling cinnamon. The standard framework for modeling mental qualities represents them via points in geometrical spaces, where distances between points inversely correspond to degrees of phenomenal similarity. This paper argues that the standard framework is structurally inadequate and develops a new framework that is more powerful and flexible. The core problem for the standard framework is that it cannot capture precision structure: for example, (...) consider the phenomenal contrast between seeing an object as crimson in foveal vision versus merely as red in peripheral vision. The solution I favor is to model mental qualities using regions, rather than points. I explain how this seemingly simple formal innovation not only provides a natural way of modeling precision, but also yields a variety of further theoretical fruits: it enables us to formulate novel hypotheses about the space and structures of mental qualities, formally differentiate two dimensions of phenomenal similarity, generate a quantitative model of the phenomenal sorites, and define a measure of discriminatory grain. A noteworthy consequence is that the structure of the mental qualities of conscious experiences is fundamentally different from the structure of the perceptible qualities of external objects. Virtue epistemology argues that knowledge is more valuable than Gettierized belief because knowledge is an achievement, but Gettierized belief is not. The key premise in the achievement argument is that achievement is apt (successful because competent) and Gettierized belief is inapt (successful because lucky). I first argue that the intuition behind the achievement argument is based wrongly on the fact that ‘being successful because lucky’ implicates ‘being not competent enough’. I then offer an argument from moral luck to argue that (...) virtue epistemologists should maintain that knowledge is no more valuable than Gettierized belief. (shrink)

The hypergrowth and hyperconnectivity of networks of artificial intelligence (AI) systems and algorithms increasingly cause our interactions with the world, socially and environmentally, more technologically mediated. AI systems start interfering with our choices or making decisions on our behalf: what we see, what we buy, which contents or foods we consume, where we travel to, who we hire, etc. It is imperative to understand the dynamics of human-computer interaction in the age of progressively more competent AI. To address the rising concern that algorithmic decision-making may reinforce discriminatory biases, researchers have proposed many notions of fairness and corresponding mathematical formalizations. Each of these notions is often presented as a one-size-fits-all, absolute condition; however, in reality, the practical and ethical trade-offs are unavoidable and more complex. We introduce a new approach that considers fairness—not as a binary, absolute mathematical condition—but rather, as a relational notion in comparison to alternative decisionmaking processes. Using US mortgage lending as an example use (...) case, we discuss the ethical foundations of each definition of fairness and demonstrate that our proposed methodology more closely captures the ethical trade-offs of the decision-maker, as well as forcing a more explicit representation of which values and objectives are prioritised. I defend the thesis that legal standards of proof are reducible to thresholds of probability. Many have rejected this thesis because it seems to entail that defendants can be found liable solely on the basis of statistical evidence. I argue that this inference is invalid. I do so by developing a view, called Legal Causalism, that combines Thomson's (1986) causal analysis of evidence with recent work in formal theories of causal inference. On this view, legal standards of proof can be (...) reduced to probabilities, but deriving these probabilities involves more than just statistics. (shrink)
